1.1 These Terms and Conditions set out important information about the MBA+ Program for Gold Card Holders and guests.
1.2 These Terms and Conditions and the Lounge Rules govern the MBA+ Program and the use of the Gold Card and AIM Lounge facilities.
1.3 Each Gold Card Holder is responsible for complying with, and ensuring that any guests comply with, these Terms and Conditions and the Lounge Rules.
1.4 These Terms and Conditions are effective from date of publication shown above and may be amended from time to time.
2.1 In these Terms and Conditions, unless the context otherwise requires:
‘AIM’ (also referred to as ‘us’) means Australian Institute of Management Education and Training Pty Limited (ACN 009 668 553);
‘AIM Course Specialists’ (formerly known as 'AIM Coaches') means AIM advisors based at AIM Lounges whom provide AIM Course Selection Services to Gold Card Holders in accordance with these Terms and Conditions;
‘AIM Course Selection Services’ means course selection services provided by AIM Course Specialists including but not limited to resume review, cover letter assistance, social media profiles, short course selections and personalised frameworks.
‘AIM Lounge or Lounges’ means the AIM Lounges and other facilities currently located in NSW - Sydney, ACT – Canberra, VIC - Melbourne, QLD - Brisbane CBD and SA - Adelaide and any other locations which may be added to the MBA+ Program from time to time;
‘AIM Short Courses’ means AIM unaccredited short courses offered by AIM as set out in the eligible AIM Short Course list from time to time;
‘Gold Card’ means the Gold Card issued to a Gold Card Holder;
‘Gold Card Holder’ (also referred to as 'you' or 'your') means a person whom is a participant in the MBA+ Program and holds a Gold Card at the relevant time;
‘Lounge Rules' means any rules, in addition to these Terms and Conditions, that AIM reasonably deems to be necessary or convenient for the administration of the AIM Lounge or its facilities and that are notified to Gold Card Holders and their guests, including any rules posted on aim.com.au or displayed in a AIM Lounge facility;
‘SIN’ means a Student Identification Number, which is issued to the Gold Card Holder by AIM.
3. MBA+ PROGRAM
3.1 The MBA+ Program is available to all ABS MBA students whom fulfil the following criteria:
(a)an ABS MBA student whom is currently studying and actively progressing an ABS MBA unit or units; or
(b)an ABS MBA student whom has graduated from the ABS MBA since January 2017.
3.3 For new students the MBA+ Program Gold Card is valid for a term of five years commencing from initial ABS MBA unit enrolment course start date.
3.4 For existing students the MBA+ Gold Card will be provided upon commencement of a unit after May 1st 2018 and will be valid for four years.
3.5 For graduates since January 2017 and students who have already commenced their last unit Gold Cards will be provided after April 16th 2018 and will be valid for two years.
3.6 The MBA+ Program is not available to ABS MBA students whom are part of a non-public, closed cohort ABS MBA program; enrolled through AIM WA; or any students’ resident outside of Australia.
4. GOLD CARD RULES
4.1 Your Gold Card will be sent to you at the time of unit enrolment and activated either;
(a)when payment for the relevant AIM Business School MBA unit is received; or
(b)at the expiration of ten (10) days from the commencement of the relevant AIM Business School MBA unit.
4.2 It may take up to ten (10) to 14 business days for your new Gold Card to be delivered and timeframes may be increased over a public holiday period.
4.3 You acknowledge and agree that the Gold Card is non-refundable, not transferable and cannot be used in conjunction with any other offer or vouchers.
5. AIM COURSE SELECTION SERVICES
5.1 AIM Courses Selection Services are only available in person at AIM Lounges that have onsite AIM Coaches
5.2 AIM Course Selection Services are available remotely via Skype or GoToWebinar for those remote from an AIM Lounge.
5.3 Appointments with AIM Course Specialists may be scheduled for a period up to two hours, per month during the MBA+ Program, subject to availability during AIM Lounge business hours.
6. AIM LOUNGE RULES
6.1 AIM Lounges are accessible during the campus opening hours, Monday to Friday in the relevant AIM Lounge location
6.2 AIM Lounge meeting rooms may be booked by Gold Card Holders for a maximum of 2 hours per day. Bookings must be made ahead of time through AIM Lounge staff and are subject to availability.
6.3 You will be required to present your valid Gold Card together with photo identification at the time of checking-in to the AIM Lounge. Entry will not be permitted without presentation of a valid Gold Card and/or photo identification.
6.4 Each Gold Card holder is permitted to bring one guest into an AIM Lounge, provided that you accompany your guest, subject to clause 6.6.
6.5 Smart, casual dress standards apply as a minimum at all times and entry may be refused if customers do not meet the standard.
6.6 AIM Lounge staff may refuse entry to any Gold Card Holder or guest at any time if, in their reasonable opinion, the Gold Card holder has not or will not comply with these Terms and Conditions, or the refusal is necessary or convenient for the orderly operation of the AIM Lounge or other facilities or the safety or comfort of other holders, their guests and staff.
7. AIM SHORT COURSES
7.1 Gold Card Holders will need to enrol in available AIM Short Courses via the personalised link found at the back of your Gold Card.
7.2 Gold Card Holders will have designated spots available in each AIM Short Course and is subject to course availability.
8. PERSONAL INFORMATION
8.1 It is a condition of the MBA+ Program that you consent and authorise AIM to collect and use the information on your application form and other information you provide to AIM and disclose it to AIM Lounge operators, and any other person (including a related body corporate, agent or contractor) for the purpose of:
(a) AIM or any of its related bodies corporate improving AIM customer service, including by means of research, marketing, product development and planning;
(b) AIM or any of its related bodies corporate marketing its products or services or the products or services of third parties; and
(c) any third party providing services to AIM, any of its related bodies corporate or Gold Card Holders in connection with the administration of the MBA+ Program.
This information may be transferred to or from Australia for these purposes. If all or any part of requested information is not provided by the Member, the relevant services may be affected.
8.2 AIM will not otherwise disclose your personal information without your consent unless disclosure is either necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.
9. CHANGES TO MBA+ PROGRAM AND TERMS AND CONDITIONS
9.1 AIM reserves the right to vary the MBA+ Program to which the Gold Card provides access, and these Terms and Conditions including but not limited to:
(a) amending which AIM Short Courses are deemed eligible short courses to be included in on the eligible AIM Short Course list;
(b) opening new AIM Lounges;
(c) closing or ceasing to operate AIM Lounges or other facilities;
(d) changing the way AIM Lounges or other facilities are operated, including contracting any third party to provide the facility or any goods or services;
(d) varying the hours of operation at any AIM Lounge or other facilities; or
(e) varying the layout, location, or other aspects of the facilities including the types of refreshments that are available, the types of rooms and the times in which they are available.
9.2 AIM will use reasonable endeavours to advise Gold Card Holders of any material changes to the MBA+ Program including but limited to by publishing the changes in myABS.
9.3 AIM will give notice of any material changes to these Terms and Conditions that will apply to a Gold Card Holder’s then current access period by providing a written notice by email or mail to an address provided to AIM by the Gold Card Holder, as well as by publishing the changes on the myABS platform or via email.
10.1 Some of the goods or services which are offered or provided to Gold Card Holders in addition to the benefits offered as part of the MBA+ Program provided by AIM may be supplied by third party suppliers. The provision of those goods or services will be subject, in each case, to the terms and conditions of the suppliers and any claims relating to the supply of those goods or services should be made to the supplier.
10.2 AIM will not be liable for refusal by any third party to accept or honour the Gold Card nor will AIM be liable for any loss or damage suffered in relation to the supply of goods or services by third parties.
10.3 Access to the Internet may be available in AIM Lounges. AIM may not supervise the use of, and does not guarantee the security or quality of, this equipment. AIM is not liable for any third party content on the Internet that the Gold Card Holder may find offensive, upsetting or defamatory. The Gold Card Holder is responsible for maintaining the security of all log-in identification information made available to them to access the Internet. AIM is not liable for any personal security breaches suffered by the Gold Card Holder or their guests when using AIM Lounge equipment or the Internet or for any loss or damage suffered as a result of the unavailability of the AIM Lounge equipment or the Internet, including interruptions during use.
10.4 Nothing in these Terms and Conditions operates to limit or exclude liability that cannot by law be limited or excluded. AIM acknowledges that the Gold Card Holder may be a consumer for the purposes of applicable State or Federal law in Australia, with the consequence that certain guarantees may be conferred on the Gold Card Holder and certain rights and remedies conferred on the Gold Card Holder, which cannot be excluded, restricted or modified. To the maximum extent permitted by law, AIM’s liability to the Gold Card Holder in respect of a breach of a guarantee or a warranty under these Terms and Conditions is limited to the resupply of the relevant benefit or benefits of the MBA+ Program.
11.1 AIM reserves the right to terminate or cease to operate the MBA+ Program at any time.
11.2 AIM reserves the right in its absolute discretion to terminate the use of any Gold Card at any time by giving such notice to the Gold Card Holder as soon as is reasonably practicable.
11.3 AIM reserves the right to terminate the Gold Card if the holder withdraws from their ABS MBA course or unit, is not actively enrolled in a current unit, or fails to make payment in the required timeframes.
